  • Why should my spouse get my retirement savings? The portion of retirement accounts acquired during your marriage are considered marital assets. Your retirement savings are subject to division, as is the case with all of your other marital assets.
  • Will I have to pay taxes on any money taken out? If your tax-deferred retirement accounts are properly divided through a Qualified Domestic Relations Order (QDRO) or a Qualified Illinois Domestic Relations Order (QILDRO), you will not incur tax liability or penalties. There are special orders for the division of military benefits.
