Child support can be changed in Illinois

In Illinois, child support is a hot topic among those who must pay and those who need the support for their children. Many have the mistaken belief that there is no going back once the support is in place. This is not true and there are legitimate reasons for changing the support amount.

First of all, the reason for changing the amount may be that you, as the one paying child support, have had a significant pay cut or may have even become unemployed. Another reason is just the opposite. Perhaps your spouse has become employed and can take on more of the financial burden than he or she could have before.

If you are the parent who has custody of the children, the burden is on you to prove that your ex-spouse has more earnings than he or she did in the past. The state of Illinois reviews each child support situation every 36 months to ensure that the amount is still appropriate. However, you may ask for a review at any time.

If you have a good relationship with your ex, you two may be able to work this out without much input from the court. However, if something should happen and the two of you are no longer on good footing, deviating from the original agreement will not sit well if it should go before a judge.

It is important to remember that the children's needs should come first and that the court may step in and make a decision with them in mind if you and your ex-spouse cannot agree.
