Collaborative law for divorcing couples in Illinois is beneficial

In Illinois, collaborative law is an increasingly popular method of getting a divorce. From the time you begin the process to the time you end, you may be looking at a shorter timeframe than a contested divorce. Since there is no waiting period mentioned in the statutes of the state of Illinois for collaborative divorce, the 90 day waiting period for a regular divorce is counted as 90 days before the commencement of the divorce instead of from the time of filing.

When you are going the route of collaborative law, you must sign a contract that states you and your soon-to-be ex-spouse along with both attorneys agree to work toward settling all issues in the process to include child support and custody, asset and debt distribution and any spousal support that may need to be made. This process is a negotiation between you and your spouse and needs to be treated as such. Children benefit from this process in a big way because they sense that you and your partner are not arguing and fighting over who gets what but that you are working together to reach a common goal.

If this method breaks down, you may still go ahead with the divorce, however, the law states that your attorney cannot represent you in court for a contested divorce. This is in place so that you and your partner are working toward the goal of achieving a mutually satisfying agreement upon settlement.
