How mediation can help in child custody cases

We've all seen it a hundred times, both in real life and the movies: a divorcing couple who can't stand the sight of one another and can't even imagine being in the same room with each other. But that's just reality, right? Marital splits are always acrimonious, bitter affairs where each person fights tooth and nail over every last detail. Thankfully, the answer is no. That's the old way of doing things. These days, the trend is mediation, which means sitting down with a neutral party, setting aside the anger and working toward a resolution that suits both parties.

Mediation, or collaborative law, can be particularly advantageous when it comes to issues of child custody. There are several reasons for this:

  • Mediation doesn't pit the splitting couple against each other. Instead, it attempts to open up lines of communication and appeal to reason. This typically creates an atmosphere of compromise, a particularly helpful mood when discussing contentious issues like child custody.
  • Mediation doesn't forego the possibility of court. If it doesn't work out, you can try it the usual way. Nothing ventured, nothing gained, as they say.
  • Mediation, when successful, can repair relationships between splitting partners, making future dealings healthier for the children involved. Keep in mind that you will be in each other's lives for the long haul.
  • Mediation is often much less expensive and time consuming than traditional divorce.
