Is divorce mediation for you?

The term divorce mediation probably conjures images of drum circles and sharing feelings in a therapist's office full of herbal teas and coffee table books like "I'm OK, You're OK." The truth is, when you're going through a divorce, everything is far from OK. And mediation may feel like the last thing that will work, especially with emotions as high as they are. But collaborative law can be cheaper and faster than a traditional divorce and there's nothing on the books that says once you try mediation that you can't then go the traditional route.

Still, there are a host of stigma that persist about collaborative law. Let's dispel some of them:

  • It's impossible to work together with your ex. This may be true, but that's what the mediation is for: to help you both be cordial enough to come to an agreement. In fact, the mediation may just repair your relationship enough to make a healthier environment for your children.
  • Attorneys are against it. Again, not true. Many family law attorneys embrace the collaborative law model.
  • There's no way I can get what I want through mediation. There's a common misconception that the only way to get paid or get custody is to take the fight to the courts and make your ex pay. That's not necessarily true. Collaborative law uses accountants and other professionals to make sure that both parties come out with a fair agreement.
