Judge makes statement on gay marriage

The U.S. Supreme Court's June ruling on gay marriage has impacted every state in the nation. Whether it's an uproar or victory, each area has specific feelings on the matter, and they are all making headlines.

A Tennessee judge has expressed his disapproval with the recent ruling by denying a couple's right to terminate their marriage regardless of the fact they both want it. The petitioners, a heterosexual couple, have been married since 2002 and do not have any children together. At their most recent court hearing, the judge denied their petition for divorce citing that the Supreme Court's recent ruling has implied that lesser courts are incompetent in identifying what is and is not a marriage, therefore making dissolution of a marriage impossible at the family court level.

When asked, the divorcing couple's attorney stated she felt the judge was simply trying to make a statement. The couple, who were not necessarily using collaborative law, shared an attorney and were seemingly in agreement on their divorce. The judge, who denied the divorce petition declined to comment on his ruling but did say that he hopes the couple can work it out.

Although this situation is taking place in Tennessee, the topic of same-sex marriage is one so heated that emotions are running high in all corners of the U.S. For couples looking for help with their divorce proceedings, whether in complete agreement or not, speaking to a skilled divorce attorney may help. Although there is no guarantee a judge won't take a cue from this Tennessee judge and use divorce proceedings as a way to make a statement, an experienced attorney can help avoid other delays.
