Collaborative divorce is not for everyone

The collaborative divorce process is not for everyone. One of the cornerstones of collaborative divorce is that both spouses can be in a room together and work towards a common goal of completing a divorce with a set of customized and personalized rules and provisions. If that isn't achievable -- if the spouses are too upset with each other and can't work towards a common goal -- then a collaborative divorce is unlikely to help.

But there are plenty of splitting couples out there that would benefit from the collaborative process. Traditional litigation and divorce can be hit-or-miss. The reason for this is that when a case goes before a judge, that judge will make crucial decisions about certain outstanding issues in the divorce. It is uncommon for these decisions to perfectly fit what each spouse wants.

Collaborative divorce brings the two parties together -- each with their own attorney -- to work out the complex and unique issues that the spouses face. You can work towards an achievable solution that focuses on your children while making necessary concessions that respect both your interests and your spouse's interests. Such collaborative divorces can foster good-faith negotiation between the two spouses and establish an acceptable and workable foundation for their post-divorce lives.

If you are considering a collaborative divorce, then you will probably have a lot of questions about the process and what it means for you. The attorneys at Goddard & Malmquist have been trained in the collaborative process, and they can help you with your divorce.
